Daily Hearing Rate (7 hours, 10:00 am to 5:00pm) $7500 plus HST per hearing day or portion thereof

Case Management Arbitration
Half-Day Motion Rate (3 hours, 10:00 am to 1:00 pm or 2:00 pm to 5:00 pm) $5000 plus HST

Claims Officer

Med-Arb
Mediation and Arbitration rates apply as set out above, with some blended rates as may be agreed under the Med-Arb Agreement, following at least one process design conference.
ADR services and rates
Deposits
All mediations must be funded by advance deposits equal to the applicable flat rate (including HST) prior to the scheduled Mediation session. Deposits are held securely in a non-interest-bearing trust account, and will be applied to the account when invoiced, in addition to any overtime or venue fees that may apply. Deposits for mediation sessions that are cancelled more than 30 days prior to the Mediation will be returned in full to the payors. Deposits for mediations that are cancelled after the no-fee cancellation deadline will be applied first to the cancellation fee, with any remainder returned to the payors.
All arbitrations and hybrid arbitrations must be funded by advance deposits based on the Arbitrator’s estimate of time required for the hearing. Deposits are held securely in a non-interest-bearing trust account. Further deposits may be requested as necessary. Any amount held on deposit above the amount charged will be returned to the parties. Deposits for arbitration dates that are cancelled more than 30 days before the scheduled hearing date(s) will be first applied to the arbitrator’s time incurred to date, and the remainder will be returned to the payors. Deposits for arbitration dates that are cancelled after the no-fee cancellation deadline will first be applied to the cancellation fee and time incurred to date, with any remainder returned to the payors.
Deposits may be paid by cheque payable to Keenberg & Company Professional Corporation In Trust, or by wire transfer (with details to be provided upon request).
Cancellation Fees
Arbitration and mediation dates that are cancelled 30 days or less before the scheduled date will be subject to a cancellation fee of 50% of the flat rate for the cancelled date or dates, as well as any additional time already incurred at the hourly rate plus HST thereon, and any non-refundable expenses already incurred.
Venue Hosting fees
Keenberg & Co has space available (one large boardroom and one separate breakout room) to host in-person two-party mediations and arbitrations for which Megan Keenberg has been appointed as a neutral. The hosting fee is $750 per party and includes lunch, coffee and snacks. Please inform KeenCo’s office manager, Victoria Larkin, of any dietary restrictions that require consideration for catering in advance at admin@keenco.ca.
